Confusion Hits Gomoa Fetteh after Appeals Court Judgement

case brought by Traditional Leaders of Gomoa Fetteh at the Gomoa East in the Central Region claiming to be landguards terrorizing residents and developers at Fetteh Kakraba has been decided by the Court of Appeal.


The case against the people of Gomoa Fetteh in the Winneba High Court, in which they claimed that they were serving as landguards in the region, was won by traditional leaders at Fetteh Kakraba.


Gomoa Fetteh filed an appeal to overturn the Winneba High Court's decision that they are landguards and should refrain from the land because the two had been litigating over ownership of lands at Fetteh Kakraba for years.


Given the judgment on the allure documented at the Accra Court of Allure, the three-part board led by Equity Philip Brilliant Mensah decided that the cases that individuals of Gomoa Fetteh have been going about as landguards is unconfirmed, nonetheless, responsibility for grounds of Fetteh Kakraba stays for the sake of individuals of Fetteh Kakraba.


Gomoa Fetteh's citizens demonstrated in the streets following the ruling, proclaiming that they had prevailed in their claim to ownership of Fetteh Kakraba lands.


However, Roland Atta kesse Hamilton, an attorney for the respondents (Fetteh Kakraba), stated to a section of the media that the ruling has been misinterpreted by the Gomoa Fetteh population.


He claimed that the issue of landguards and restraining orders was the subject of the court's decision, not the ownership of the land.


He stated that Respondents Fetteh Kakraba possess three judgments from the Swedru, Cape Coast, and Winneba High Courts that have not been overturned by any court with jurisdiction.
