Man jailed 30 years over Prof Benneh’s murder

The Accra High Court has convicted Ebenezer Kwayisi, an apprentice mason, to 30 years in prison for his involvement in the death of Professor Emmanuel Yaw Benneh, 

a former law lecturer at the University of Ghana.

The 28-year-old admitted guilt to aiding and abetting manslaughter and was sentenced to prison today by the court, which was presided over by Justice Mary Maame Ekue Yanzuh.

Kwayisi, who was accused of helping someone commit murder, chose to enter a plea under Section 239(2) of the Criminal and Other Offenses 

(Procedure)Act, 1960 (Act 30) after he and the prosecution came to an understanding that he should enter a plea of guilty to manslaughter instead of murder, since the latter carries a harsher punishment.

A person accused of a crime may, upon agreement with the prosecution, enter a plea of guilty to a related crime under Section 239 (2) of Act 30.

In accordance with the agreement, the prosecution suggested a 30-year sentence, which the court approved.

The prisoner will perform hard labor to fulfill his sentence.

Murder
In September 2020, Prof. Benneh was brutally murdered at his home.

James Nana Womba, the primary suspect in the case who worked as a cleaner at Prof. Benneh's home and admitted to killing the lecturer, passed away on October 17, 2020, while in police prison.

According to the prosecution, the deceased was discovered dead in a pool of blood in a prone position in a hallway that led to his bedroom on September 12, 2020, at around eight in the morning. 

He had a white rope tied around his hands and a green rope around his legs, just below the knees, and a piece of cloth partially inserted into his mouth.

According to the report, a closer look at the victim's body showed numerous signs of facial assault.

It continued by saying that the authorities also discovered bloodstains on the walls, a hand glove, and a blood-stained white rope at the site.

Admittance
The prosecution claims that on September 13, 2020, Womba was brought into custody and his fingerprints were obtained, submitted to the

Furthermore, during the course of the investigation, Womba admitted to the crime and named Kwayisi and one other collaborator, who was subsequently freed. After that, the two were taken into custody at different hiding places.

Exams
The prosecution told the court that further research showed that in August of 2020, Womba plotted to kill Professor Benneh in his home.

It stated that two weeks later, Womba got in touch with Kwayisi to help him carry out the plan.

According to the prosecution, Kwayisi gave his consent, and on September 10, 2020, he went to Professor Benneh's home where he and Womba carried out their plot to assassinate the professor.

The prosecution brought forth the allegation that the accused had collaborated in his cautionary utterances.
